This was an action commenced in Justice Court in Fond du Lac County on June 8, 1945 by Leo Kaiser, plaintiff, against Better Farms, Inc., a Wisconsin corporation, defendant. The action was thereafter transferred to the Municipal Court for Fond du Lac County on June 15, 1945. Plaintiff sought to recover a sum of money alleged to be due on defendant's written promise to pay plaintiff a bonus for his services. Defendant answered, and also filed a counterclaim for damages arising out of an alleged breach of contract by plaintiff. Plaintiff did not reply to the counterclaim. The matter was tried to the court without a jury and judgment entered dismissing plaintiff's complaint and granting defendant judgment on its counterclaim in the sum of $82.50. Plaintiff appealed to the circuit court for Fond du Lac County and on March 29, 1946 the circuit court reversed the judgment of the municipal court, entered judgment for plaintiff on his complaint and dismissed defendant's counterclaim. Defendant appeals.
