In this case, plaintiff Moses Sebunya is suing the County of Cumberland and various county employees for violations of his civil rights under 42 U.S.C. §§ 1981 and 1983. He alleges employment discrimination and retaliation for exercise of his First Amendment right to free speech. Defendants moved for summary judgment on several grounds, including qualified immunity for the individual defendants. The district court, adopting the magistrate Judges recommended decision, granted the motion in part and denied it in part. Denying summary judgment for defendants Esther Clenott, Dewey A. Martin, Francine Breton, and Jeffery L. Newton, the court found that there were genuine issues of fact that precluded a finding of qualified immunity. Defendants now seek to appeal from the partial denial of their summary judgment motion.
